What is a Will?

A Will is a legal document that sets out how you want the things you own to be distributed when you die. Wills aren’t just for people who own property or have lots of money. If you have a Will in place, the distribution of your estate will be governed by the terms in your Will which can help avoid disputes once you pass.

Why do you need to make a Will?

If you don’t have a Will, you don’t have a say about how your estate is distributed. If you die without a Will (known as ‘dying interstate’) your estate will be distributed to your relatives according to a legal formula (called the ‘intestacy rules’). This could be very different from what you wanted or intended to happen. Dying ‘interstate’ can also cause complications, delays and extra costs for those you leave behind.

As your life changes, your Will needs to remain up to date to ensure your estate is distributed according to your wishes. You are able to change your Will at any time as long as you have the mental capacity to do so.
